TERMS & CONDITIONS OF PURCHASE

These Terms and Conditions of Purchase apply to all products purchased through ThePadelTech.com. By placing an order, you agree to be bound by these terms.

1. ORDERS AND CONTRACT FORMATION

  • Offer to Purchase: By completing the checkout process, you are making an offer to purchase goods or services. A legally binding contract is only formed once we send you an "Order Shipped" or "Order Ready for Collection" email.

  • Refusal of Order: We reserve the right to decline or cancel any order for reasons including, but not limited to, stock unavailability, pricing errors, or suspicion of fraudulent activity.

2. PRICING AND PAYMENT

  • Currency: All prices are listed in South African Rand (ZAR).

  • Payment Methods: We accept secure payments via EFT,  PayStack or Cash on collection.

  • Accuracy: While we strive for accuracy, if a product is listed at an incorrect price due to a technical error, we reserve the right to cancel orders placed at the incorrect price and issue a full refund.

3. REFURBISHED GOODS (CONSPICUOUS NOTICE)

  • Nature of Goods: In accordance with the Consumer Protection Act, please note that rackets sold in our "Refurbished" section have been previously used and professionally restored.

  • Disclosure: Any significant cosmetic imperfections (scratches or chips that do not affect play) will be disclosed in the product description. By purchasing, you acknowledge that you are aware of the reconditioned status of the goods.

4. THE 7-DAY "COOLING-OFF" PERIOD

  • Under the ECT Act, you have the right to cancel your purchase of goods within 7 days of receipt for any reason ("change of mind").

  • Conditions: The item must be returned in the exact condition it was received, including all tags and original packaging.

  • Cost: You are responsible for the direct cost of returning the goods to us.

5. STATUTORY WARRANTY (SECTION 56)

  • All goods (including refurbished rackets) come with an implied warranty that they are of good quality and free of defects relative to their described condition.

  • If a refurbished racket fails structurally within 6 months due to a defect in our restoration process, you are entitled to a repair, replacement, or refund at our expense (including shipping).

  • Note: This warranty does not cover "clash damage" (hitting a wall or partner's racket) or normal wear and tear of grips and protectors.

6. DELIVERY AND RISK

  • Risk: The risk of loss or damage to the goods passes to you once the package is delivered to your specified address or collected from a partner club.

  • Inspection: You are encouraged to inspect your package upon delivery. If the packaging is visibly damaged, please note this with the courier or refuse the delivery.

7. POPIA COMPLIANCE

  • Your personal information (name, address, and contact details) is collected solely to process your order and ship your goods. We take all reasonable steps to protect your data in accordance with the Protection of Personal Information Act.
